Terms & Conditions

These Terms & Conditions (“Agreement”) govern all memberships, classes, programs, rentals, and services offered by Heritage Martial Arts Academy Sdn. Bhd. (“the Academy”, “we”, “us”). By registering as a member, attending classes, or using our facilities, you (“Member”, “Renter”, “Participant”) agree to the following terms:

1. Memberships & Fees

1.1 Memberships are non-transferable and non-refundable except as expressly stated in this Agreement.
1.2 Fees must be paid in full before classes or rentals commence. Unpaid memberships or bookings may be suspended or cancelled.
1.3 The Academy reserves the right to adjust membership fees, rental rates, or class schedules with prior notice.

2. Booking & Attendance

2.1 All classes, private training sessions, and facility rentals must be booked in advance.
2.2 Members and Renters are expected to arrive on time. Setup and pack-up must be included within the booking period.
2.3 The Academy reserves the right to refuse entry or participation to any person who is disruptive, unsafe, or in breach of Academy rules.

3. Cancellations & Refunds

3.1 Memberships: Members may cancel ongoing memberships in accordance with the cancellation policy provided at the time of registration.
3.2 Rentals & Bookings: Cancellations must be made at least 24 hours in advance to be eligible for rescheduling or credit. No-shows or late cancellations are non-refundable.
3.3 The Academy reserves the right to cancel classes or rentals due to unforeseen circumstances (e.g., safety, maintenance, public health requirements). Credits or rescheduling will be offered in such cases.

4. Code of Conduct

4.1 All Members, Renters, and Participants must respect the Academy’s instructors, staff, and fellow members.
4.2 Behaviour that is unsafe, unlawful, discriminatory, or disruptive may result in immediate suspension or termination of membership or rental without refund.
4.3 Proper training attire, hygiene, and respectful use of facilities are required at all times.

5. Facilities & Equipment

5.1 Members and Renters may use only the designated training areas and equipment.
5.2 All equipment must be handled responsibly and returned to its original condition.
5.3 Any damage, breakage, or loss caused by a Member or Renter will be charged at repair or replacement cost.
5.4 Food and drinks are not permitted on the mats. Only water bottles are allowed.
5.5 Cleaning of mats, training gear, and equipment after use must follow Academy guidelines.

6. Safety & Liability

6.1 Martial arts and fitness training carry inherent risks. All Members and Participants accept full responsibility for their own safety and participation.
6.2 The Academy is not liable for injuries, accidents, or damages sustained during classes, training, or rentals, except where required by law.
6.3 All participants (or their parents/guardians, if under 18) must sign a Liability Waiver & Indemnity Form before engaging in any activities.

7. Instructors & Classes

7.1 Only Academy-approved instructors may conduct classes within the facility unless under a rental agreement.
7.2 Renters conducting group or private sessions are fully responsible for the safety, supervision, and conduct of their students/clients.
7.3 The Academy reserves the right to monitor and regulate any instruction conducted on the premises.

8. Privacy & Data Protection

8.1 Personal data provided by Members and Renters will be collected, used, and stored in accordance with our Privacy Policy and Malaysia’s Personal Data Protection Act (PDPA 2010).
8.2 By registering or booking with the Academy, you consent to the processing of your personal data as described in our Privacy Policy.

9. Photography & Media

9.1 The Academy may take photos or videos during classes and events for promotional purposes.
9.2 Members who do not wish to appear in media content must notify the Academy in writing.

10. Termination of Agreement

10.1 The Academy reserves the right to terminate memberships, rentals, or bookings immediately and without refund if the Member or Renter breaches these Terms & Conditions.
10.2 Members may terminate their membership in accordance with the Academy’s cancellation policy.

11. Governing Law

11.1 These Terms & Conditions are governed by the laws of Malaysia.
11.2 Any disputes arising under or in connection with this Agreement shall be subject to the jurisdiction of the Malaysian courts.
